They are concerned that the previous owner, who will remain as manager, will continue to operate the bar in an irresponsible manner. This location has had numerous problems with violence, public drunkenness, vandalism, and assaults. Additionally, the area has a high crime rate.

I have the capability, qualifications, and reliability to hold a liquor license because: "I have prior experience in the bar business. I have attended a training course and am familiar with the liquor laws. I will operate this business in compliance with the laws."

Staff Recommendation - Staff recommends disapproval of this application based on Police Department and Planning Department recommendations for disapproval and neighborhood protests.
The Police Department disapproval is based on the previous owner's continued involvement in this business as the manager. While Mr. Kirkman has been the owner of this business, he has had 134 police reports written and more than 36 arrests related to problems at this bar. Of the police reports written, 13 occurred in August 2008; 6 of which were related to violent crimes involving employees of the bar. These reports include aggravated assaults, liquor violations, thefts, drug related crimes, and armed robbery.
The Planning Department disapproval is based on the applicant's failure to obtain the required Use Permit.
